1. Service Description
DeleteYourData provides privacy consultation services to help individuals exercise their data deletion and privacy rights under applicable state laws including the California Consumer Privacy Act (CCPA), Virginia Consumer Data Protection Act (VCDPA), Washington My Health My Data Act (MHMDA), and Nevada SB220.
Our services are provided through Sagebrush Services with legal oversight from Neon Law® attorneys.
2. No Guarantees
IMPORTANT: We make best efforts to help you exercise your privacy rights, but we cannot and do not guarantee:
- Complete data deletion from all companies
- Compliance from any specific business
- Faster response times than legally required
- Deletion of data that companies can legally retain
- Prevention of future data collection
Results depend entirely on individual company compliance with applicable state privacy laws.
3. Service Limitations
Our services are subject to legal and practical limitations:
- Legal coverage: Only businesses covered by applicable state privacy laws are required to comply
- Exceptions: Companies may legally retain data for business, legal, or security purposes
- Verification: Companies may require identity verification before processing requests
- Public records: Publicly available information may not be deletable
- Enforcement: We cannot force compliance or take legal action on your behalf
4. Your Responsibilities
As our client, you agree to:
- Provide accurate information necessary for deletion requests
- Comply with reasonable identity verification requirements from companies
- Understand and accept the limitations of privacy laws
- Not use our services for illegal or fraudulent purposes
- Respect legitimate business needs for data retention
5. Professional Standards
We commit to:
- Professional communication with businesses and their representatives
- Accurate representation of applicable privacy laws
- Honest assessment of realistic expectations
- Attorney oversight of all legal aspects of the service
- Transparent reporting of results and company responses
6. Prohibited Uses
You may not use our services to:
- Evade legitimate legal obligations or investigations
- Facilitate fraud, identity theft, or other illegal activities
- Harass or threaten businesses or their employees
- Circumvent legitimate security or anti-fraud measures
- Delete data you do not have legal authority to request deletion of
7. Third-Party Compliance
We work with businesses to encourage compliance with privacy laws, but:
- We are not responsible for third-party compliance or non-compliance
- Company response times and methods are beyond our control
- We cannot override legitimate business exceptions to deletion requirements
- Some businesses may not be covered by applicable privacy laws
8. Attorney-Client Relationship
Our service includes attorney oversight from Neon Law®, but:
- This does not create a direct attorney-client relationship between you and Neon Law®
- We do not provide individual legal advice beyond privacy rights consultation
- For complex legal matters, you may need to retain separate counsel
- We do not represent you in legal proceedings against non-compliant companies
9. Limitation of Liability
To the maximum extent permitted by law:
- We are not liable for company non-compliance with privacy laws
- We are not responsible for consequences of data deletion or retention
- Our liability is limited to the fees paid for our services
- We disclaim warranties about specific outcomes or results
10. Privacy and Confidentiality
We protect your privacy throughout our service:
- We only collect information necessary to submit deletion requests
- We do not share your information except as required for the service
- We maintain confidentiality of your privacy consultation
- We follow professional standards for data protection
11. Service Modifications
We may modify our services or these terms:
- Changes to these terms will be posted on our website
- Continued use of services constitutes acceptance of modified terms
- We may discontinue services with reasonable notice
- Major changes affecting active clients will be communicated directly
12. Governing Law
These terms are governed by Nevada state law. Any disputes will be resolved in Nevada courts with jurisdiction over Sagebrush Services.
